Participation in this promotion is deemed acceptance of these Terms and Conditions. 2. Entry is only open to Australian residents aged 18 years or over. Individuals entering on behalf of a business must have permission from the business to enter. Employees (and their immediate families) of the Promoter, participating case dealers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 4. Promotion commences on 01/04/10. Entries close 5:00pm AEST on 01/08/10 ("Promotional Period"). 5. To enter the Major Prize Draw, individuals must fully complete a signed retail order for any new complete Case Construction Equipment (excludes parts and accessories) at any participating Case Construction Equipment dealer during the Promotional Period. 6. To enter the Runner Up Prize Draw and Monthly Draws, individuals must visit www.caseoffers.com.au or www.caseused.com.au, follow the prompts to the competition registration page, input the requested details and submit the fully completed entry form during the Promotional Period. 7. Incomplete, indecipherable or illegible entries will be deemed invalid. 8. Only one (1) entry into the Runner Up Prize Draw and Monthly Draws permitted per person. Multiple entries permitted in to the Major Prize Draw only, subject to the following: (a) only one (1) entry permitted per fully completed signed retail order; and (b) each signed retail order must be submitted separately and in accordance with entry requirements. Entries close for each draw at 5:00pm AEDST/ AEST (depending on the date) on the dates specified in the table below. All draws will take place at Kobelco CNH Australia, Unit 1, 1 Foundation Place, Prospect NSW 2148 on the dates specified in the table below. Un-drawn entries in each Monthly Draw will be entered into any subsequent Monthly Draws and all entries made online will be entered into the Runner Up Prize Draw. Only entries made via a signed retail order, as specified in clause 5, will be entered into the Major Prize Draw. Winners will be notified by email and phone and the Major Prize winner's name will be published in The Australian on 20/08/10. The Promoter's decision is final and no correspondence will be entered into. The first valid entry drawn in the Major Prize Draw will win a trip for three (3) people to the Gold Coast, QLD valued at up to $4,000.00 depending on point of departure. Prize includes two (2) nights twin share four (4) star rating accommodation and three (3) V8 Gold Coast Supercars Pitt Passes for 23/10/10 and 24/10/10. If the winner is not from the Gold Coast or Brisbane, the prize also includes return economy airfares from the winner's nearest capital city. If the winner is from the Gold Coast or Brisbane, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash. Spending money, meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken to coincide with the V8 Gold Coast Supercars event with flights departing on 22/10/10 and is subject to booking and flight availability. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in. 11. The first valid entry drawn in the Runner Up Prize Draw will win Fabian Coulthard's framed gloves and boots (both will be signed) that he wore during a 2010 Season V8 Supercar race valued at $250.00. 12. The first valid entry drawn in each Monthly Draw will win a signed Oakley Grandstand V8 racing shirt valued at $78.99. Winners will be contacted via email by the Promoter to select their choice of size out of the following: Small; Medium; Large; Extra-Large; or Double Extra-Large, subject to availability. 13. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. The V8 Gold Coast Supercars Pitt Passes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organizers hereby expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize. 15. Total prize pool value is up to $4,565.96. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash. 16. A draw for the Major Prize, if unclaimed, may take place on 23/09/10 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winner's name, if any, will be published in The Australian on 30/09/10. A draw for any remaining unclaimed prizes (excluding Major Prize) may take place on 15/11/10 at the same time and place as the original draw, subject to any directions from a regulatory authority. 17. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 18. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 19. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. 20.
